NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING

Notice is hereby given that sealed bids will be received by the City Clerk for the City of Pella, Iowa, at the City Offices at 825 Broadway, Pella, IA 50219 before 1:00 PM, on June 25, 2020 for the furnishing of Fiber to the Premise Access Network Equipment for Pella Municipal Electric Utility, Pella, Iowa. Bids received after the deadline for submission for bids as stated herein shall not be considered and shall be returned to the late bidder unopened. This is a Unit Pricing Bid; quantities shown are based on projections of subscriber penetration.

At said time and place, bids will be publicly opened, read for consideration and award by the City Council at its meeting on Tuesday, July 7, 2020 at 7:00 PM, in the Council Chambers in the Public Safety Complex, 614 Main Street, Pella, Iowa. (The bid opening may be held by teleconference depending upon public health considerations).

Public Notice is hereby given that at 7:00 P.M on July 7, 2020, the City Council of the City of Pella will, in the Council Chambers in the Public Safety Complex, 614 Main Street, Pella, Iowa, hold a public hearing regarding the proposed adoption of the plans, specifications, form of contract, and estimate of cost for the furnishing of Fiber to the Premise Access Network Equipment for Pella Municipal Electric Utility, Pella, Iowa.

Bidders are encouraged to attend the Pre-Bid Conference to be held at Public Safety Complex, 614 Main Street, Pella, Iowa, May 26, 2020 at 1 PM (the meeting may be held by teleconference depending upon public health considerations). Minutes of the Pre-Bid Conference will be prepared by the Engineer and distributed to all plan holders.

The City is seeking two alternative Bids for this project.

The project is generally described as the provision of Access Equipment and Network Configuration for the Pella Municipal Electric Utility, Pella Telecommunications FTTP Network, 2020-PellaFTTP-AE01. The fiber network is being constructed throughout the City of Pella.

Alternative 1: Traditional Hardware Implementation

The provision of access equipment and network configuration to support this FTTP project. Alternative 1 consists of a traditional hardware approach for the OLT and other base system components, business and residential ONTs and CPEs with ancillary components such as remote gateways, and mesh networks. It also includes components to support the population of MDUs in the community.

Alternative 2: Virtual SDN Base Implementation

The provision of access equipment and network configuration to support this FTTP project. Alternative 2 consists of use of virtualized approach using vOLTs and/or VoLTHA and other base system components, and traditional business and residential ONTs and CPEs with ancillary components such as remote gateways, and mesh networks. It also includes components to support the population of MDUs in the community.

The above equipment shall be provided in accordance with the specifications and proposed form of contract now on file in the City offices in said City of Pella, Iowa, by this reference made a part hereof, as though fully set out and incorporated herein.

The City is not seeking construction for any part of this bid.

Copies of said plans and specifications and form of contract are now on file in the office of the Clerk. Material suppliers desiring a copy of the bid forms and specifications for individual use may obtain them from the office of the Engineer, at NewCom Technologies, Inc., 6000 Grand Ave., Des Moines, Iowa 50312, 800/626-6234, newcom@newcomtech.com at no charge (please enter PELLA ACCESS EQUIPMENT PROJECT #2020-PellaFTTP-AE01 in the subject line of your email). Plan holders will receive minutes and any addenda from the Engineer.

Bids shall be submitted on a unit price basis using Appendix D – Bid Form 0300. Pricing for components should be valid for material releases through 2021. The Bidder hereby acknowledges that the City, in advertising for public bids for this project, reserves the right to reject any or all alternatives in determining the items to be included in the contract. Designation of the lowest responsive, responsive bidder to be based on comparison of the total bid for the selected alternative.

Each bid shall be accompanied by a bid security as defined in Iowa Code Section 26.8, in the form of a Bid Bond, Certified Check, Cashier’s Check or a Certified Share Draft in a separate sealed envelope in an amount equal to five (5) percent of the total amount bid. A Bid Bond must be on the form provided with the specifications. The Certified Check or Cashier’s Check shall be drawn on a state-chartered or federally-chartered bank. A Certified Share Draft shall be drawn on a state-chartered or federally-chartered credit union. The bid security shall be made payable to the CITY OF PELLA, as security that if awarded a contract, the Bidder will enter into a contract at the prices bid and furnish the required Performance and Payment Bonds. The bid security must not contain any conditions either in the body or as an endorsement thereon. Such bid security shall be forfeited to the City as liquidated damages in the event the successful bidder fails or refuses to enter into a contract within ten (10) days after the award of contract and post a satisfactory Performance and Payment Bond. No oral, facsimile, e-mail, telegraphic or telephonic bids or modifications will be considered.

The City Council reserves the right to reject any or all bids, to waive informalities, irregularities or technicalities in any bid and to accept the bid and enter into such contract as it deems to be to the best interest of the City.

First equipment delivery is scheduled for September 1, 2020 for testing and initial integration. A customer pilot is expected late 4th quarter of 2020. General deployment will begin early in 2021 and will follow the schedule included in the specifications.

To the extent required by Iowa law, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference allowed shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident. Failure to submit a fully completed Appendix B – Bidder Status Form with the Proposal may result in the proposal being deemed nonresponsive and rejected.

The City may award a contract to the lowest responsive, responsible bidder. The City reserves the right to defer acceptance of any bid for a period not to exceed thirty (30) days after the date bids are received and no bid may be withdrawn during this period.

This Notice is given by authority of the City Council of the City of Pella, Iowa, for the Pella Municipal Electric Utility.
